This Privacy Policy explains how FormFruit, Inc. (“FormFruit,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you use Formfruit.com and our related services.

1. Scope and roles

This Policy applies to Formfruit.com and the FormFruit services. When a customer creates forms and collects responses, that customer generally determines why and how response data is used, and FormFruit processes it on the customer’s behalf. Questions about a specific form should first be directed to the organization that provided it.

2. Information we collect

  • Account information, such as name, email address, authentication details, and account settings.
  • Customer content, including uploaded documents, form fields, branding, instructions, form responses, and packet recipient information.
  • Payment and subscription information. Payment card details are handled by our payment providers rather than stored directly by FormFruit.
  • Usage and device information, such as IP address, browser, device, pages viewed, interactions, logs, approximate location, and cookies or similar technologies.
  • Communications and support information when you contact us.

3. How we use information

  • Provide, operate, personalize, and secure the Services.
  • Create accounts, authenticate users, process transactions, and provide support.
  • Store and process forms, documents, responses, and instructions at the customer’s direction.
  • Provide AI-assisted document conversion and editing features.
  • Monitor reliability, prevent fraud and abuse, troubleshoot issues, and improve the Services.
  • Send service, security, billing, and administrative communications and, where permitted, product communications.
  • Comply with law and enforce our agreements.

4. How we disclose information

We do not sell personal information for money. We may disclose information to:

  • Service providers that support hosting, storage, authentication, analytics, communications, AI processing, support, and payments.
  • The FormFruit customer that created a form or packet, including responses submitted to that customer.
  • Authorities or other parties when reasonably necessary to comply with law, protect rights and safety, or investigate abuse.
  • A buyer, successor, or adviser in connection with a financing, merger, acquisition, reorganization, or sale of assets.
  • Other parties at your direction or with your consent.

5. AI processing

Information submitted to AI-assisted features may be processed by FormFruit’s AI service providers to generate requested output. Do not submit information to those features unless you have authority to do so. AI-generated results should be reviewed before use.

6. Cookies and analytics

We use necessary cookies and similar technologies for authentication, security, and core functionality, and may use analytics technologies to understand usage and improve the Services. Browser settings may allow you to control cookies, but disabling necessary cookies can prevent features from working.

7. Data retention

We retain information for as long as reasonably necessary to provide the Services, maintain business and security records, comply with law, resolve disputes, and enforce agreements. Retention depends on the type of information, account status, customer instructions, and legal requirements. Customers control retention and deletion of form responses subject to these limits.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information. No system is completely secure, and we cannot guarantee absolute security. Protect your account credentials and use appropriate sharing and authentication settings for sensitive forms.

9. International transfers

FormFruit and its providers may process information in the United States and other countries where privacy laws may differ. Where required, we use appropriate safeguards for international transfers.

10. Your choices and privacy rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of personal information, object to or restrict processing, or withdraw consent. You may also have a right to appeal a denied request or complain to a regulator. To submit a request, contact info@formfruit.com. We may verify your identity and may direct form recipients to the customer responsible for the form. Authorized agents may submit requests where permitted by law. You will not be discriminated against for exercising privacy rights.

11. Children’s privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 provided personal information, contact us so we can review and delete it as appropriate. Users under the age of majority must have authorization from a parent or legal guardian.

12. Third-party links and services

Third-party websites and services have their own privacy practices. This Policy does not cover information processed independently by those third parties.

13. Changes to this Policy

We may update this Policy and will post the revised version with a new effective date. We will provide additional notice of material changes where required by law.
