Terms of Service

1. Eligibility and acceptance

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, a parent or legal guardian must authorize your use. If you use the Services for an organization, you represent that you have authority to bind it. By creating an account or using the Services, you agree to these Terms and our Privacy Policy.

2. Accounts

You must provide accurate information, protect your credentials, and promptly notify us of unauthorized use. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or create risk for FormFruit, users, or others.

3. The Services

FormFruit provides tools for creating, hosting, sharing, completing, and exporting digital forms and form packets, including AI-assisted document conversion. Features may change over time. You are responsible for reviewing forms and AI-generated output before publishing, sharing, or relying on them. FormFruit does not provide legal, medical, tax, or other professional advice.

4. Your content and responsibilities

You retain ownership of documents, forms, branding, responses, instructions, and other content you submit (“User Content”). You grant FormFruit a limited, worldwide license to host, process, reproduce, and display User Content only as needed to operate, secure, support, and improve the Services.

• You must have all rights and permissions needed for User Content and its collection.
• You must provide required notices and obtain consents from form recipients.
• You may not upload unlawful, infringing, deceptive, malicious, or highly sensitive information unless your use complies with applicable law and the Services are appropriate for it.
• You may not probe, disrupt, reverse engineer, abuse, or use the Services to send spam or violate another person’s rights.

5. AI-assisted features

AI output can be incomplete, inaccurate, or unsuitable for your purpose. You must independently review all generated fields, wording, structure, and exports. You retain responsibility for decisions, forms, and communications produced with AI-assisted features.

6. Form recipients and shared links

You control the forms and packets you publish, their recipients, and whether a packet requires authentication. Anyone with access to an unrestricted share link may be able to view and submit the linked form. You are responsible for selecting appropriate access settings and distributing links securely.

7. Fees, subscriptions, and taxes

Paid plans and usage charges are presented before purchase. Unless stated otherwise, subscriptions renew automatically until canceled. Fees are nonrefundable except where required by law or expressly stated at purchase. You are responsible for applicable taxes. We may change pricing prospectively with notice required by law. Payments are processed by our payment providers under their terms.

8. Intellectual property

The Services, software, design, trademarks, and related materials are owned by FormFruit or its licensors. These Terms grant you a limited, nonexclusive, nontransferable, revocable right to use the Services while your account is active. No other rights are granted.

9. Third-party services

The Services may rely on or link to third-party providers. FormFruit is not responsible for third-party services, content, availability, or practices, and your use of them may be governed by separate terms.

10. Termination

You may stop using the Services at any time. We may suspend or terminate access for a material breach, legal requirement, security risk, nonpayment, or conduct that harms the Services or others. Upon termination, your right to use the Services ends. Provisions that by their nature should survive will survive, including ownership, disclaimers, liability limits, indemnity, and dispute terms.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMFRUIT DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMFRUIT AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS. FORMFRUIT’S TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FORMFRUIT DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so they may not apply to you.

13. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless FormFruit and its affiliates from claims, damages, losses, and expenses arising from your User Content, your forms or data-collection practices, your violation of these Terms, or your violation of another person’s rights.

14. Governing law and disputes

These Terms are governed by Delaware law, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Delaware, and each party consents to their jurisdiction and venue. Before filing a claim, contact info@formfruit.com and allow 30 days for informal resolution.

15. Changes and general terms

We may update these Terms and will post the revised version with a new effective date. Material changes will receive notice as required by law. If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with our business. These Terms and referenced policies are the entire agreement regarding the Services.
